FAMILY ISSUES

Question: If I am adopted out, can I still inherit from my bio logical family in an intestacy?

Answer: No. You can only inherit from your adopted family in an intestacy. If your biological family wants you to inherit from their estate, they must do a will.

Question: If my siblings and I have different fathers and our mother dies without a will, who inherits her estate?

Answer: If she is legally married, her surviving husband will inherit 50% of her estate. The remaining 50% of her estate will be equally divided among all her surviving children. If she owned land, her surviving husband must be enrolled to inherit any of her land.

Question: If my step parent or foster parent dies without a will, can I inherit from his or her estate?

Answer: Only if you have been legally adopted by your step parent or foster parent. If your step parent or foster parent wants to make sure you inherit from his or her estate, he or she must do a will.
