Seneca Nation Cannabis Regulatory Authority

The Seneca Nation is currently accepting letters of intent for those interested in serving on the following board:

SENECA NATION CANNABIS REGULATORY AUTHORITY
3 – MEMBERS

PURPOSE:
The purpose of the Cannabis Regulatory is to regulate and monitor the cultivation, processing, and distribution of cannabis and cannabis products on Nation Territory to the fullest extent permitted by law, and to enforce and carry out the provisions and duties prescribed by the Seneca Nation Adult-Use Cannabis Law.

The Authority is a governmental instrumentality of the Nation, having autonomous existence separate and distinct from the Nation. For the purpose of taxation, civil and regulatory jurisdiction, the Authority is deemed a subordinate arm of the Nation and shall be entitled to all of the privileges and immunities of the Nation.

MEMBERSHIP:
The Authority shall have three (3) members, with one member serving as chairperson, each of which shall be known as a Commissioner of the Authority. The Authority Chairperson shall be elected yearly by the members of the Commission. In the event of a three-way tie, the Chairperson shall be appointed by the Nation Council.

Each Commissioner shall be appointed by the Nation Council by Resolution, and shall generally serve a four (4) year term. However, upon establishment of the Authority, the Commissioners shall initially serve staggered terms; one (1) of the Commissioners having an initial term of four (4) years; one of the Commissioners having an initial term of three (3) years; and one of the Commissioners having an initial term of two (2) years.

All Commissioners must be:
• Members of the Nation
• Over the age of 25
• Not convicted of a felony
• Shall have relevant experience and knowledge that will enable them to successfully serve in their role as a Commissioner
• No Commissioner during his/her tenure shall actively participate in Cannabis production of any type (growing, distributing or processing) or be employed by a Licensee.
• If a Commissioner develops an economic interest in a cannabis industry activity, or seeks to establish one, during the course of that person’s term as a Commissioner, that person shall resign from their position as a Commissioner immediately.
• The Seneca Nation Ethics Law shall apply to the Commissioners.
