Resolution – Regarding Drug Related Crimes

AT THE REGULAR SESSION OF COUNCIL OF THE SENECA NATION OF INDIANS HELD ON JUNE 11, 2022 AT THE WILLIAM SENECA BUILDING ON THE CATTARAUGUS TERRITORY.

EXTENDING INELIGIBILITY FOR ANNUITY PAYMENTS FOR MEMBERS WHO AID OR ABET A NON­MEMBER SUBJECT TO AN EXCLUSION ORDER OR ARE CONVICTED OF FELONY DRUG RELATED CRIMES

MOTION: by Presley Redeye, seconded by Timothy Waterman, that the Seneca Nation Council approves the following resolution:

WHEREAS: the Seneca Nation has an obligation to promote the general welfare and a duty to protect the health and safety of our community; and

WHEREAS: recognizing the danger illegal drug use poses to our community, the Seneca Nation President has, from time to time, issued Exclusion Orders against non-members reasonably suspected to be involved in the distribution of illegal drugs within the Nation’s Territories; and

WHEREAS: the Council passed Resolution R-08-08-20-08, which provides that any Nation member who is determined to have aided and abetted the individual subject to the Exclusion Order, as determined by the President, shall be deemed ineligible to receive annuity payments for a period of up to one ( 1 ) year; and

WHEREAS: the Council passed Resolution R-08-08-20-08, which provides that any Nation member who is determined to have aided and abetted the individual subject to the Exclusion Order, as determined by the President, shall be deemed ineligible to receive annuity payments for a period of up to one ( 1 ) year; and

WHEREAS, Resolution R-08-08-20-08, also removed annuity eligibility for one year for those Nation members who were convicted of a felony drug related crime of manufacture, sale and/or distribution of controlled substances; and

WHEREAS, the Nation Council seeks to impose additional penalties upon those that aid and abet criminal drug­ related activity committed by individuals subject to Exclusion Orders, or are convicted of a felony drug related crime;

NOW, THEREFORE, BE IT RESOLVED, that any Nation member who is determined to have aided and abetted an individual subject to an Exclusion Order shall be subject to suspension of annuity payments, elder benefits, disability benefits, and any other direct health and welfare payments (“Direct Benefits”) for a duration to be determined by the Peacemakers Court; and

BE IT FURTHER RESOLVED, that any Nation member who convicted in a court of competent jurisdiction of the equivalent of a felony drug crime of manufacture, sale and/or distribution of controlled substances, as defined in the Seneca Nation’s Drug Policy, as amended, shall be subject to suspension of Direct Benefits for a duration to be determined by the Peacemakers Court.
