Exclusion Order:
Excluding Donel Cathcart from Seneca Nation Territories
WHEREAS, The Seneca Nation has the inherent right to exclude individuals from the Territories of the Seneca Nation who cause harm or pose a threat to the health and safety of the Seneca Nation and its community members; and
WHEREAS, the Seneca Nation Council has adopted laws prohibiting the sale, use and manufacture of illegal narcotics within the territory of the Seneca Nation; and
WHEREAS, at a Regular Session of Council held on November 18, 2023, the Seneca Nation Council adopted the Exclusion Law (CN: R-11-18-23-13), which authorizes the President to issue Exclusion Orders to non-Senecas that pose a serious threat to the public health, welfare, and safety of the Seneca Nation; and
WHEREAS, the President of the Seneca Nation has the authority, pursuant to the Constitution of the Seneca Nation, to enforce the laws of the Seneca Nation; and
WHEREAS, on February 27, 2024, it was reported by the Erie County Sheriffs Department that Donel Cathcart was arrested for possession of a significant amount of narcotics destined for sale on Seneca Nation Territory; and
WHEREAS, the President has determined that Donel Cathcart poses an immediate threat to the health and safety of the Seneca Nation and its community members.
NOW THEREFORE BE IT ORDERED that Donel Cathcart is hereby indefinitely excluded from all Seneca Nation Territories, effective immediately; and be it
FURTHER ORDERED, that should Donel Cathcart enter Seneca Nation Territory at any time for any reason, he shall be deemed to be trespassing; and be it
FURTHER ORDERED, that any member of the Seneca Nation who is determined to have knowingly harbored or assisted Donel Cathcart to remain on, or return to, Seneca Nation Territory in violation of this Order may be charged in the Seneca Nation Peacemaker’s Court with aiding and abetting in violation of this Order and the Exclusion Law, with potential penalties including the withholding of Nation annuity payments and direct health and welfare benefit payments (elders, disability, etc.); and be it
FURTHER ORDERED, that any person holding an interest in the lease of Seneca Nation lands who is determined to have knowingly harbored or assisted Donel Cathcart to remain on, or return to, such leased premises on Seneca Nation Territory in violation of this Order may be charged with a breach of their lease, with potential penalties including lease termination; and be it
FURTHER ORDERED, that upon Donel Cathcart’s re-entry into or presence on the Seneca Nation Territories, the Seneca Nation Marshal’s Office, in cooperation with local law enforcement agencies, is authorized and directed to remove him from the Territories, to continue to remove him should he return, and to press charges, with assistance from the Nation’s Legal Department, on the Nation’s behalf for such continuing trespass activity.

Excluding Justin Bond from Seneca Nation Territories
WHEREAS, The Seneca Nation has the inherent right to exclude individuals from the Territories of the Seneca Nation who cause harm or pose a threat to the health and safety of the Seneca Nation and its community members; and
WHEREAS, the Seneca Nation Council has adopted laws prohibiting the sale, use and manufacture of illegal narcotics within the territory of the Seneca Nation; and
WHEREAS, the President of the Seneca Nation has the authority, pursuant to the Constitution of the Seneca Nation, to enforce the laws of the Seneca Nation; and
WHEREAS, it has been determined that Justin Bond, a non-member of the Seneca Nation, is involved in the sale, manufacture and/or distribution of illegal narcotics and poses an immediate threat to the health and safety of the Nation and its community members.
NOW THEREFORE BE IT ORDERED that Justin Bond is hereby excluded from all Seneca Nation Territories, effective immediately, for a period of one year; and be it
FURTHER ORDERED, that any member of the Seneca Nation who is determined to have knowingly harbored or assisted Justin Bond to remain on or return to the Seneca Nation Territory in violation of this Order may be charged in the Seneca Nation Peacemaker’s Court with aiding and abetting in violation of this Order, with potential penalties including up to withholding of Nation annuity payments and direct health and welfare benefit payments (elders, disability, etc.); and
FURTHER ORDERED, that any person holding an interest in the lease of Seneca Nation lands who is determined to have knowingly harbored or assisted Justin Bond to remain on or return to Seneca Nation Territory in violation of this Order may be charged with a breach of their lease, with potential penalties including up to lease termination; and be it
FURTHER ORDERED, that upon Justin Bond’s entry into or presence on the Seneca Nation Territories, the Seneca Nation Marshal’s Office, in cooperation with local law enforcement agencies, is authorized and directed to remove him from the territories and to continue to remove him should he return; and be it
FURTHER ORDERED, that Justin Bond’s eligibility to enter the Nation Territories will be reassessed by the Nation prior to the expiration of this one-year exclusion and banishment from the territories.
